    The SEC Derivatives Rule: Navigating Implementation Challenges

    The SEC recently adopted Rule 18f-4, which is a landmark shift in the regulation of funds and BDCs that use derivatives and other transactions under Section 18 of the Investment Company Act of 1940. As the compliance date approaches, members of Dechert’s Rule 18f-4 implementation team will discuss key issues that funds and BDCs will need to address in developing derivatives risk management programs, navigating the limited derivatives user exception, and tips and tricks for implementation efforts.
