Japan Publishes Big Bang Regulations for Comment

Washington, DC, November 3, 1998 - Proposed regulations implementing financial reforms in Japan and addressing issues of concern to foreign investors have been published for comment. These proposals concern many reforms already scheduled to go into effect on December 1, 1998.

The proposed regulations apparently clarify two important issues related to overseas investment managers. Specifically, under the proposed regulations:

  • Overseas managers will not be required to register in Japan if they provide investment advice solely to advisers licensed in Japan or to Japanese investment trust management companies; and
  • Advisers licensed in Japan will be able to delegate discretionary authority to overseas managers.
